From January 1st, 2020, the Energy Performance Certificate (EKB) is mandatory for the purchase, sale and rental of buildings and structures.
EKB is a document containing information on a building's minimum energy requirements and energy consumption classification, insulation properties and efficiency of heating and/or cooling systems. The aim of the EKB is to use energy and energy resources in buildings effectively and efficiently, to avoid wasting energy and to protect the environment.
Energy performance certificate (EKB) Obligatory when buying a property
According to the Energy Efficiency Law No. 5627 and the Energy Performance of Buildings Regulations issued under it, buildings that received planning permission before January 1, 2011 are “existing buildings”; Those granted building permits after this date were considered "new builds".
While new builds are required to submit the EPC upon acquisition of the Occupancy Certificate; Existing buildings and buildings that did not have planning permission prior to January 1, 2011 but have not received occupancy permits have been granted a 10-year grace period for issuance of the EPC. As of January 1, 2020, a new regulation was publicly announced by the Land Registry and Cadastre Directorate to prevent the accumulation of land registries. According to the Regulation in the case of purchase, sale and lease annotation transactions related to real estate and independent sections in which buildings and structures are located, if the building or its independent section has EKP at the time of application; “There is an energy certificate. It was given to me.” or if it is explained that there is no EKP, “I accept/agree to make a sale/rental notice without an EPC.” at the appropriate place in the application document is considered valid for the procedure to be carried out. However, the Directorate of Land Registry and Cadastre did not provide any explanation as to when this regulation will come into effect and when the obligation to have EKP in purchase, sale and rental annotation transactions of the building, which is included in the Energy Regulation benefits in buildings, will be definitively refunded .

Who is entitled to commission EKB?
For new buildings; It is considered an authorized institution to issue EPCs to natural or legal persons who have personnel who have successfully completed the free training for the Certificate of Consulting and Engineering Services (SMM) and the issuance of the Energy Performance Certificate, issued by the competent professional chamber, the attached to the TMMOB. Which documents are required for the EKB?
• Architectural project
• Thermal insulation project
• Electrical project
• Mechanical installation project (heating, cooling, ventilation)
Buildings and structures for which no EKB is required
• Buildings outside the adjacent area and with a total construction area of less than 1000 m²,
• buildings with a total usable area of less than 50 m²,
• greenhouses and workshops,
• buildings in which production activities are carried out in industrial zones,
• buildings with a planned useful life of less than 2 years,
• Buildings such as barns, barns, warehouses, arsenals and warehouses that are built individually and do not require heating or cooling,
• The Turkish Armed Forces, the Ministry of National Defense and its subsidiaries, and the Undersecretariat of National Intelligence are excluded from the scope of buildings and structures that require an Energy Performance Certificate (EPC).
Period of validity and classification of the EKB
EKB is valid for 10 years from the date of issue.
EKB consists of 7 categories. While class A indicates the most efficient level in the document classified from A to G; Class G indicates the lowest efficiency level. New builds must have the lowest Class C ECU.
